By accessing or using Nuvflo ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Nuvflo. We may update these Terms from time to time; continued use after changes constitutes acceptance.
2. Service Description
Nuvflo provides AI-powered tools to assist with refund requests and billing disputes. Our Service includes:
- Manual mode: Paste billing information to generate refund request drafts
- Connected mode: Connect your email account to detect and manage refund opportunities
- Pro Studio: Analytics and tracking dashboard for refund operations
AI-Generated Content Disclosure
Nuvflo uses artificial intelligence (AI) and large language models (LLMs) to generate draft communications. You understand and agree that:
- AI-generated content is provided as a starting point for your review
- You are responsible for reviewing and approving all content before it is sent
- AI systems may occasionally produce errors or inaccuracies
- We do not guarantee specific outcomes or success rates
3. User Authorization and Representation
Your Authorization to Us
By using Nuvflo's connected email features, you authorize us to:
- Access your email account using the OAuth permissions you grant
- Read billing-related emails to extract relevant information
- Generate draft communications on your behalf
- Send communications only after you explicitly approve each message
What We Do NOT Do
- We do not send any communication without your explicit approval
- We do not claim to be you or represent that we are the account holder
- We do not negotiate on your behalf or make binding commitments for you
- We do not access your email continuously or scan unrelated messages
Your Representations
By using the Service, you represent and warrant that:
- You are the legitimate owner or authorized user of the email account you connect
- You have the authority to make refund requests for the transactions in question
- All information you provide is accurate and truthful
- You will review and verify all AI-generated content before approving it
- You will not use the Service for fraudulent, abusive, or illegal purposes
4. User Responsibilities
You agree to:
- Use the Service only for lawful purposes and legitimate refund requests
- Provide accurate information when using our services
- Review all AI-generated content for accuracy before sending
- Comply with all applicable laws regarding commercial communications
- Not attempt to reverse engineer, copy, or misuse our AI models or systems
- Not use the Service to harass merchants or send abusive communications
- Not exceed fair use limits or abuse API/service resources
5. Payment and Subscription Terms
Billing
Paid subscriptions are billed in advance on a monthly or annual basis. Payment is processed by Stripe.
Fair Use Policy
Subscription plans include case limits as described on our pricing page:
- Pro Monthly: Up to 50 refund cases per month
- Pro Annual: Up to 100 refund cases per month
- Enterprise: Custom limits based on agreement
Refunds & Cancellation
Subscription fees are generally non-refundable. However, if unsatisfied within the first 14 days, contact support@nuvflo.io. You may cancel at any time; access continues until the end of your billing period.
6. Intellectual Property
Our Rights: Nuvflo and its licensors own all rights in the Service, including software, design, trademarks, and content (excluding your data).
Your Rights: You retain ownership of any data you provide or generate through the Service. You grant us a limited license to process your data solely to provide the Service.
7. Privacy and Data
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to our data practices as described in the Privacy Policy.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- AI-generated content will be accurate, complete, or appropriate
- Any refund request will be successful
- The Service will meet your specific requirements
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- Nuvflo shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Nuvflo shall not be liable for lost profits, lost data, or business interruption
- Nuvflo's total liability shall not exceed the fees you paid in the 12 months preceding the claim
- We are not liable for any losses resulting from AI-generated content you approve and send
10. Termination
We may suspend or terminate your access to the Service at any time for:
- Violation of these Terms
- Fraudulent or abusive use
- Non-payment of fees
- Any reason at our sole discretion with reasonable notice
Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination will survive.
